The companies are required to communicate its invoices and shipping documents to the Tax Authority, as well as electronically communicate the inventories.

Context
The Decree Law No. 198/2012, of August 24 2012, introduced the requirement to communicate invoices and shipping documents to the Portuguese Tax Authority (AT) in order to fight the informal economy and tax evasion.
The Government Budget proposal for 2015 (approved on the Assembleia da República) foresees an amendment to the Decree Law previously identified mandatory to electronically communicate the inventories.
On the scope of this change, we expect the publication of a decree to define the characteristics and the structure of the communication file. Note: This information is based on the support manual Communication of Stock, made available by the Tax Authority (AT).
Frequently asked questions
The following questions are meant to clarify all doubts on the requirement to communicate inventories:
1.Who needs to communicate the inventory?
All natural or legal persons based, with a stable establishment or fiscal tax residence in Portuguese territory with an organized accounting and that are required to prepare the inventory.
2.Who doesn't need to communicate the inventory?
The ones previously mentioned whose business volume on the fiscal year previous to the mentioned communication does not exceed €100.000.
3.What needs to be communicated?
The inventory regarding the last day of the previous fiscal year/period must be communicated. According with the support manual, the product information to be included on the file is:
- Type: Product Category;
- Identifier;
- Description;
- Code;
- Quantity;
- Unit;
- Value.
Note: The Value communication is going to be mandatory from 2020 forward for files regarding 2019.
4.What is the deadline to electronically communicate the inventory?
The normal deadline to electronically communicate the inventory is until January 31st of the following year. However, the natural or legal person who adopts a different tax period of the calendar year must communicate until the end of the following month after that period.
5.How to communicate the inventory file?
The communication must be performed by data electronic transmission using a file with characteristics and structure to be defined by decree by the member of the Government responsible for the financial area. However, according to the support manual published by the AT, the communication can happen in one of two ways:
- File in text format;
- File in XML format.
6.When does the requirement to communicate inventories comes into force?
Taxable persons must communicate to the AT the inventories regarding the period of 2014 until January 31st, 2015.
7.Our company meets the conditions to communicate the inventory files, however, there is no inventory left. Should we communicate it nonetheless?
According to the support manual, companies without stock are required by law to communicate the inventory and, as such, must declare on the e-invoice portal that there is no stock. There is no need to build the empty file.
8.My item table includes items with quantities in stock and items without stock. In this case, should I communicate the entire table of items?
According to the manual, the items that, at the inventory date do not exist in stock (for example, out of stock), must not be on the files communicated to the AT.
9.Our company has two warehouses, in different cities and uses two different information systems. Should we communicate one or two inventory files?
When communicating the inventory, the companies can specify more than one file with all their stock information. For more information, please see the support manual.
10.What are the steps to prepare the process of communicating the inventory file?
The process of communicating the inventory file includes the following steps:
- Counting and physical control of the inventory;
- Verification of the existent inventory in the application;
- Record of potential settlements;
- Issuing of the inventory file;
- Communication of the inventory file to the AT.
11.If an error is detected on the stock file sent to the AT, is it possible to replace the file?
Currently, there is no documentation available that allows to answer that question.
